General terms & Conditions

Warranty and right of return

Our standard luminaires are covered by warranty and return policy according to ALEM09.

Returns must be authorised by Exaktor/Proton Lighting AB. Contact us to get a return number to mark the delivery note with. Always state the batch no./TO no. when communicating about warranty and return issues. Return deduction for standard products in undamaged packaging is 20%.

If the product is not in perfect condition, ExaktorsProton Lighting AB is entitled to a larger return deduction. Special products or customised products cannot be returned.

Transport damage

If transport damage has occurred, the buyer must notify the freight forwarder within 8 days.

Terms & conditions

Payment terms

30 days net. Penalty interest is charged after the due date. The penalty interest rate is the reference rate plus 8.00 percentage points.

Terms of delivery

Deliveries are made free of freight and packaging according to ALEM 09 for orders with a net invoice value of over SEK 10,000. For orders with a net invoice value of less than SEK 10,000, the buyer is responsible for shipping.

Recognised delivery date refers to the time when the goods leave Exaktor/Proton Lighting AB’s warehouse.

Quotes

Validity: The offer is valid for 30 days from the quotation date, unless specified otherwise. Any index-linked increments will be stated. Delivery time applies subject to intervening sales.

Deviations from offers: If the offer is accepted and a purchase is made in part or with amendments not in keeping with the offer, the seller reserves the right to renegotiate the terms and conditions.

Documents: Documents, drawings and specifications produced by the seller are the property of the seller and may not be communicated to a third party without written consent from the seller.

Returns

All returns must be authorised by Exaktor/Proton Lighting AB. Returns shall be labelled with the received return number. For returns, the buyer shall state the number and date of the seller’s invoice and/or delivery note for the goods in question.

Only returns due to defects or other causes for which Exaktor/Proton Lighting AB has been responsible will be accepted at no extra cost to the buyer. In case of returns, which are due to reasons other than the above, the buyer will be credited with the net invoice value with a deduction of 20% for normally stocked goods. For returns to be approved by Exaktor/Proton Lighting AB, the goods must be returned in new condition, with all parts intact and in unbroken packaging. If the product is not in perfect condition or is due to something other than the above, Exaktor is entitled to a larger return deduction.

Special products or customised products cannot be returned.

The buyer is responsible for return shipping and the risk of returned goods until Exaktor/Proton Lighting AB has acknowledged receipt of the returned goods in writing.

Goods that do not include LED components and that are not returned within three months from the date of delivery will not be returned. Goods containing LED components that are not returned within two months from the date of delivery will not be returned.

Warranty and complaint

In the event of a fault, the buyer must make a written complaint on Exaktor/Proton Lighting AB’s complaint form.

Defects which were or should have been noticed when the goods were handed over to the purchaser shall be notified within five working days thereafter and before the goods are installed. In other cases, the goods shall be reported within ten working days after the defect has been noticed or should have been noticed or has otherwise come to the buyer’s attention through a complaint from another party.

Exaktor/Proton Lighting AB’s liability for delivered goods is stated in ALEM 09, however with the limitation that the period of liability may be shorter in accordance with the manufacturer’s specification regarding the lifetime of the electronic components. Exaktor/Proton Lighting AB’s liability is conditional upon full compliance with Proton Lighting AB’s installation instructions during the installation and use of the goods. Before a product is returned, it must be labelled with a return number. If transport damage has occurred, the buyer must notify the forwarder within eight days.

If transport damage has occurred, notification must be made by the buyer to the forwarder within 8 days.

Proprietary rights

We reserve proprietary rights to sold property until full payment has been received.

Other terms and conditions

In addition to the aforementioned terms and conditions, an agreement between the parties, the terms and conditions therein, and ALEM 09 apply. In the event of conflicting terms in the parties’ agreement, the above terms and conditions, and ALEM 09, the terms and conditions in the agreement shall take precedence over the above terms and conditions and ALEM 09.
